What is a GAO bid protest?

A GAO protest is a bid protest filed with the Government Accountability Office, which must decide it within 100 calendar days, and which has strict filing deadlines — solicitation challenges before proposals are due, other grounds within 10 days of when you knew or should have known of them.

GAO states the deadlines plainly. A challenge to the terms of a solicitation must be filed before the time set for receipt of initial proposals. Every other ground must be filed within 10 days of when the protester knew or should have known of the basis of protest, with a special exception tied to a required debriefing. Days are calendar days, and a deadline falling on a weekend, federal holiday or GAO closure moves to the next business day.

GAO must decide a protest within 100 calendar days. That is why it is the main forum: it is fast by the standards of any comparable dispute process.

The suspension of performance is a separate clock and the one people miss. Under FAR 33.104(c)(1), the agency must suspend performance or terminate the award when it receives notice of a GAO protest filed within 10 days after contract award, or within 5 days after the date offered for a required debriefing, whichever is later. Miss that window and your protest can be perfectly timely while the work proceeds anyway.
